The Kano state House of Assembly election petition tribunal has nullified the election of Magaji Zarewa of the All Progressives Congress (APC) in the rerun election of Rogo constituency held in January.
Justice AM Yakubu, who presided over the tribunal on Friday, July 24, declared Jibril Falgore of the Peoples Democratic Party (PDP) as the duly elected member of Rogo constituency in the Kano state House of Assembly.
Recall that Falgore had challenged the legality and competence of Zarewa to contest in the election, arguing that he did not resign his position as the Director-General of the Kano State drug and medical consumables supply agency 30 days before the election.
He said the Zarewa’s act contravened the provisions of the electoral act as amended. Falgore also challenged the conduct of the entire election, insisting that there were irregularities.
In his judgment, Justice Yakubu said both the oral and written evidence adduced by the counsel for the petitioner and that of the respondents “satisfactorily proved that Magaji Dahiru Zarewa of the APC did not resign his position 30 days to the rerun election of Rogo constituency in the state House of Assembly.”
The tribunal also ordered INEC to present the certificate of return to Falgore, who was the first runner-up during the election.
