Justice Oluremi Oguntoyinbo of the Federal High Court Ikoyi has discharged four suspects charged with one-time popular movie maker, Seun Egbegbe for fraud.
Egbegbe, the Managing Director of Ebony Production and four others were arraigned by the police for alleged fraud to the tune of N39 million; $90,000 and £12,550.
After spending 42 months in prison custody, Justice Oguntoyinbo, discharged the four other suspects, but sentenced the filmmaker.
Egbegbe, who welcomed a baby while in jail is serving out his sentence of seven years at Ikoyi Correctional facility. He has already spent three years, and will likely be released in 2026.
He was found guilty of one out of the 44 count charges leveled against him by the police.
According to the police, the Yoruba filmmaker fraudulently obtained the money from over forty Bureau De Change Operators in Lagos between 2015 to March 2017.
Justice Oluremi Oguntoyinbo declared that 43 of the 44 count charges were crumbled because of lack of witnesses to substantiate their claims.
In her ruling, Justice Oluremi decried that the prosecuting team, adding that they failed in the responsibility to produce evidences, to be backed with witness on the Counts 4, 19 and 21.
Lamenting that police tampered with the money recovered from the suspects, Justice Oguntoyinbo also ruled that all the money recovered from Egbegbe as evidence should be returned to him.
