Why You Can’t Sue Your Husband For Rape, Lawyer Stan Aleke Sparks Debate

Abuja-based lawyer, Stan Alieke, has stated that marital rape is not a crime in the Nigerian criminal code.

The lawyer who took to social media to educate Nigerians about consensual sex, also noted that once a couple is properly married, the husband has full access to the wife’s body and she can’t sue him for rape.

Further, Aleke added that in the area of consent, it can be withdrawn at any time during sex, adding that if a man refuses to stop after he has been told to by his partner, anything he does afterward can be termed rape, including ejaculating into the partner without her permission.

He pointed out that under the law, a man cannot claim to have been raped by a woman, explaining that the law only recognizes a woman being raped by a man, while also adding that only a sane, mature and mentally sound person can grant consent to sex.
